تتولى "الشركة"، المشار إليها من الآن فصاعدًا باسم "الشركة"، تثبيت منتجات بروتكشن برو على أجهزة العميل بهدف أساسي هو التخفيف بشكل استباقي من المخاطر المحتملة المرتبطة بالخدوش والأضرار. ومع ذلك، لا بد من الاعتراف بأنه على الرغم من تطبيق هذه الضمانات الخارجية القوية، إلا أنها لا تهدف إلى توفير ضمان مطلق ضد حدوث الخدوش أو الأضرار، سواء ظهرت داخليًا أو خارجيًا على الجهاز. تظل الشركة ملتزمة بنشر تدابير الحماية بجدية مع توضيح احتمال ظهور احتمالات غير متوقعة
وفقًا لهذه الشروط والأحكام المنصوص عليها، فإن تسمية "العميل" تتعلق بأي فرد أو كيان يستفيد جهازه من الحماية الممنوحة عن طريق تثبيت منتجات بروتكشن برو التي تيسرها الشركة، والتي تشمل الأشخاص الطبيعيين والاعتباريين
عند قبول تثبيت منتجات بروتكشن برو التي تقدمها الشركة، يؤكد العميل صراحةً على الالتزام بالشروط والأحكام التالية
أ) ستقوم الشركة بدقة بتثبيت منتجات بروتكشن برو للعميل، إلى جانب الميزة الإضافية المتمثلة في توفير استبدال مدى الحياة لمنتجات بروتكشن برو المذكورة
ب) تجدر الإشارة إلى أن تغطية الاستبدال تشمل حصريًا منتجات بروتكشن برو التي قامت الشركة بتثبيتها، وبالتالي تستبعد السيناريوهات الأخرى
ت) تعفى الشركة من أي مساءلة تتعلق بالأضرار التي لحقت بالجهاز المحمي. يتحمل العميل وحده المسؤولية عن أي أضرار يتعرض لها الجهاز
ث) يوافق العميل رسميًا على تعويض الشركة وحمايتها ضد أي وجميع المطالبات والخسائر والنفقات، بما في ذلك أتعاب المحاماة المعقولة، التي قد تنشأ بسبب أو فيما يتعلق بأي خرق لهذه الشروط والأحكام
ج) تمارس هذه الشروط والأحكام سلطة ملزمة على العميل وكذلك على أي خلفاء أو معينين أو منقولين للعميل
ح) تحتفظ الشركة بصلاحية إجراء التعديلات على هذه الشروط والأحكام دون سابق إنذار
خ) تعتمد إدارة وتفسير هذه الشروط والأحكام على قوانين سلطنة عمان
د) في حالة الحكم على أي بند ضمن هذه الشروط والأحكام بأنه غير صالح أو غير قابل للتنفيذ، فإن الأحكام المتبقية تظل قوية وفعالة
ذ) تشكل هذه الشروط والأحكام مجتمعة الاتفاقية الشاملة التي تحدد نطاق التزام الشركة تجاه العميل فيما يتعلق بتثبيت منتجات بروتكشن برو
عند تثبيت منتجات بروتكشن برو، يتعين على العميل الإقرار وقبول شرط الامتناع عن استخدام الجهاز طوال فترة التعافي المحددة. تم تصميم هذا الشرط لدعم أداء الجهاز وتحسينه، وهو المبدأ الذي وافق عليه العميل
تقوم الشركة بتمديد سياسة استبدال شاملة مدى الحياة لمنتجات بروتكشن برو، بشرط أن يظل المنتج مثبتًا بشكل ثابت على الجهاز المحمي وبالترادف، يتم فرض رسوم استبدال رمزية. تتطلب فعالية امتياز الاستبدال هذا تقديم فاتورة الشراء للتحقق من صحتها. ومن الضروري التأكيد على أنه عند إزالة منتجات بروتكشن برو من الجهاز المحمي، سيتم إلغاء الحق في الاستبدال مدى الحياة على الفور، مما يعفي الشركة من أي التزام بإجراء الاستبدال
يقتصر نطاق ضمان الاستبدال مدى الحياة المنسوب إلى ميزة منتجات بروتكشن برو حصريًا على الجهاز المحدد الذي تم تثبيته عليه. هذا الاستحقاق غير قابل للتحويل إلى أي جهاز بديل
تقوم الشركة بتمديد بروتوكول الإرجاع واسترداد الأموال لمدة 15 يومًا لمنتجات بروتكشن برو، بما في ذلك البديل لتفعيل الاستبدال بدون تكلفة في حالات عيوب التصنيع أو الأخطاء المحددة. تتوقف صلاحية هذا البروتوكول على ألا يُعزى الخلل إلى إهمال العميل، بما في ذلك حالات مثل استخدام الجهاز أثناء فترة التعافي، أو التعامل دون المستوى المطلوب، أو حوادث السقوط المتعددة، أو الخدوش، أو التعرض لدرجات حرارة مرتفعة. يتعين على العميل إثبات أي مطالبة، ومن الجدير بالذكر أن الشركة تحتفظ بحق اللجوء إلى اللجوء القانوني في حالة إساءة استخدام السياسة. وبعد فترة الـ 15 يومًا، ستقوم الشركة بفرض رسوم الخدمة مقابل التثبيت المرتبط باستبدال منتجات بروتكشن برو
من خلال الاستفادة من خدمات الشركة، يقر العميل ويوافق صراحة على أن الشركة تحتفظ بالحق في رفض تثبيت خدمتها على الأجهزة التي تظهر أي شكل من أشكال الضرر أو التي تحتوي على شاشات ضعيفة. ويشمل ذلك الأجهزة التي تتميز بشاشات متشققة، بالإضافة إلى تلك التي تحتوي على مكونات مكررة، من بين حالات أخرى. ومن المهم التأكيد على أن الشركة لن تتحمل مسؤولية أي ضرر يلحق بالجهاز نتيجة تثبيت المنتج على جهاز تالف مقدم من العميل
عند الاستفادة من الخدمات التي تقدمها الشركة، يدخل العميل عن طيب خاطر في التزام ملزم بالالتزام بالشروط والأحكام المنصوص عليها. تجسد هذه الشروط والأحكام بشكل جماعي الاتفاق الشامل بين العميل والشركة، مما يجعل أي ترتيبات شفهية أو كتابية سابقة، تشمل على سبيل المثال لا الحصر، الإعلانات أو المنشورات عبر الإنترنت أو المواد الإعلامية أو العروض التقديمية المماثلة، لاغية وباطلة بالمقارنة
"The Company," henceforth referred to as the "Company," undertakes the installation of ProtectionPro Products onto the Client's devices with the primary aim of proactively mitigating the potential risks associated with scratches and damages. Nevertheless, it is imperative to acknowledge that despite the implementation of these robust external safeguards, they do not purport to provide an absolute guarantee against the occurrence of scratches or damages, whether they manifest internally or externally on the device. The Company remains committed to diligently deploying protective measures while clarifying that unforeseen eventualities may still arise.
Pursuant to these stipulated Terms and Conditions, the designation 'Client' pertains to any individual or entity whose device benefits from the safeguarding conferred by the installation of ProtectionPro Products facilitated by the Company, encompassing both natural and legal persons.
Upon embracing the installation of ProtectionPro Products extended by the Company, the Client expressly affirms adherence to the ensuing terms and conditions:
a) The Company will meticulously effectuate the installation of ProtectionPro Products for the Client, coupled with the added benefit of a lifelong replacement provision for said ProtectionPro Products.
b) Noteworthy is that the replacement coverage exclusively encompasses the ProtectionPro Products installed by the Company, thus precluding other scenarios.
c) The Company shall be exempt from any accountability pertaining to damages sustained by the safeguarded device. The Client shall singularly assume responsibility for any detriments sustained by the device.
d) The Client solemnly agrees to indemnify and hold the Company invulnerable against any and all claims, losses, expenditures, and outlays, inclusive of reasonable attorney fees, that may arise due to or in connection with any breach of these terms and conditions.
e) These terms and conditions shall exercise binding authority over the Client as well as any successors, assigns, or transferees of the Client.
f) The Company retains the prerogative to effect modifications to these terms and conditions without antecedent intimation.
g) The governance and interpretation of these terms and conditions shall be contingent upon the laws of the Sultanate of Oman.
h) In the event any provision within these terms and conditions is adjudged invalid or unenforceable, the remaining provisions shall remain robust and efficacious.
i) These terms and conditions collectively constitute the comprehensive accord delineating the scope of the Company's commitment to the Client concerning the installation of ProtectionPro Products.
Upon the installation of ProtectionPro Products, it is incumbent upon the Client to acknowledge and accept the requirement of refraining from utilizing the device throughout the designated healing period. This stipulation is designed to uphold and optimize the device's performance, a principle to which the Client is in agreement.
The Company extends a comprehensive lifetime replacement policy for the ProtectionPro Products, subject to the condition that the product remains consistently affixed to the safeguarded device and in tandem, a nominal replacement fee is levied. The efficacy of this replacement privilege necessitates the presentation of the purchase invoice for validation. It is imperative to underscore that upon removal of the ProtectionPro Products from the protected device, the entitlement to lifetime replacement will be promptly nullified, absolving the Company of any obligation to effectuate a replacement.
The scope of the lifetime replacement guarantee attributed to the ProtectionPro Products feature is confined exclusively to the particular device onto which it has been affixed. This entitlement is strictly non-transferable to any alternate device.
The Company extends a 15-day return and refund protocol for the ProtectionPro Products, encompassing the alternative to effectuate a no-cost replacement in cases of identified manufacturing defects or faults. This protocol's validity is contingent upon the defect not being attributable to the Client's negligence, including instances such as device usage during the Healing Period, substandard handling, multiple incidents of dropping, scratches, or exposure to elevated temperatures. It is incumbent upon the Client to substantiate any claim and worth noting that the Company retains the prerogative to resort to legal recourse in the event of policy misuse. Subsequent to the 15-day period, the Company will levy service charges for the installation associated with a replacement of the ProtectionPro Products.
Through the utilization of the Company's services, the Client explicitly recognizes and concurs that the Company reserves the right to decline the installation of its service on devices that exhibit any form of damage or possess impaired screens. This encompasses devices featuring cracked screens, as well as those incorporating duplicated components, among other instances. It is important to emphasize that the Company shall not assume responsibility for any harm inflicted upon the device due to the installation of the Product on a damaged device presented by the Client.
Upon availing themselves of the services proffered by the Company, the Client willingly enters into a binding commitment to adhere to the stipulated Terms and Conditions. These Terms and Conditions collectively embody the comprehensive accord between the Client and the Company, rendering any antecedent verbal or written arrangements, encompassing but not confined to advertisements, online publications, informational materials, or analogous presentations, null and void in comparison.
